Terms and Conditions 2024​​

1. Company means Sam Hurt (Sam) which is the trading name.
2. Client means any person who purchases goods and services from Sam.
3. Goods/Services mean the articles specified in the quotation.
4. Quotation/Estimate means a statement of work, or other similar documents describing the goods and services to be provided by Sam.
5. Terms and Conditions means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by Sam.
6. Validity. All quotations are valid for one calendar month from the date of issue, subject to fluctuations in the prices of materials. Prices cannot be guaranteed after this date.
7. Cancellation policy: (a)Sam requires 21 days notice to cancel work and return the deposit fee; (b)Sam reserves the right to charge for the quoted cost of my time if I am unable to secure other work and you cancel within 21 days; (c)If Sam can secure other work, he reserves the right to retain the deposit fee for administration costs and charge for any hours lost due to cancellation.
8. Communication. As a Contractor, Sam always aims to keep you informed and up to date with any changes to the working agreement. He asks that the Client will commit to doing the same.
9. Invoices and quotes. Sam provides invoices to all Clients and a detailed quote with time and materials laid out before confirmation of the work. If the nature of the work changes due to unforeseen circumstances or, if via the process of carrying out the work more time is required to complete the job, this will be addressed verbally or via email during the course of the work.
10.Covid. Sam asks that you make him aware of anyone experiencing Covid symptoms within your household. As a contractor if Sam has Covid or similar symptoms a lateral flow test will be done and the Client will be informed of the result.
11.Changes of dates. If for any unforeseen circumstance, such as illness, Sam is unable to undertake the work on the agreed date, he will carry out the work as soon as possible. He asks that you give him 21 days notice if you would like to change dates. 1
12.Delaying work. If the Client needs to postpone the agreed work due to unforeseen circumstances, the next available date will be given.
13.Payment Terms. Unless otherwise agreed, 15% of labour costs to be paid as a deposit on confirmation of booking. The balance is to be paid within 48 hrs of the invoice date. The costs of all materials is requested prior to the start of any job. For larger contracts of more than a week, a deposit and payment terms are agreed on an individual basis.
14.Disputes. In the event there is a dispute with the invoice or work carried out, any disputes should be raised in writing within 5 days of invoice date. Should Sam not receive written notification of a dispute within this time period, payment is due within the agreed terms.
15.Variations and Extras. Any unforeseen work or variations will be agreed before commencement to a fixed quotation where possible.
16.Co-Operation: (a)The Client will co-operate with Sam and provide him with any information reasonably required to carry out the works in a timely fashion; (b)The Client will be responsible for the provision of reasonable access to water, and toilet facilities at their cost; (c) The Client will make available reasonable secure storage space for the duration of the works for tool storage; (d)Responsibility for all works carried out and/or materials delivered to site shall be at the Client’s risk from delivery.
17.Clerical Error. Any typographical, clerical or other error in quotation, invoices or other documentation issued by Sam will be subject to correction without any liability.
18.Gas and Electrical Equipment/Appliances. Owing to insurance restrictions Sam cannot fit, adjust or attend to any electrical, gas or plumbing equipment. 19.Damage. Whilst all due care and diligence will be taken, Sam cannot be held responsible for any cracking or damage that may occur by movement or vibration during the course of the works.
20.Dust/Dirt. Whilst all due care and diligence will be taken, Sam cannot be held responsible for any dust/dirt that may be caused during the period of work. In addition he cannot be held responsible for any damage caused to personal items left within the work area. These should be relocated or covered before arrival on site.
22. By agreeing to my terms and conditions, as the client you grant me permission to use client photos of their property for internet purposes. The intended use of the photos are limited to marketing, website and social media. If you do not agree please inform me when agreeing to the terms and conditions for work.
21.Force Majeure: neither party shall be liable for any default due to any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest or other event beyond the reasonable control of either party.
22. Law: This contract is subject to the law of England and Wales.
