Terms and Conditions and Privacy Notice 2025

Definitions​

1.   Company or He means Sam Hurt (Sam) which is the trading name.

2.   Client, or You means any person/s who purchases goods and services from Sam.

3.   Goods/Services means the articles specified in the quotation.

4.   Site means any land or premises provided by the Client where the services will be delivered.

5,   Terms and Conditions means the terms and conditions of supply set out in this document and any special terms and conditions agreed in writing by Sam.

6.   Quotation/Estimate means a statement of work, or other similar documents describing the goods and services to be provided by Sam.

 

Estimates and Quotations

7.   All quotations/estimates are indicative unless clearly specified as fixed-price on the estimate/quotation.

8.   All quotations are valid for one calendar month from the date of issue, subject to fluctuations in the prices of materials unless otherwise agreed in writing. Prices        cannot be guaranteed after this date and are subject to availability.  

9.   Sam provides invoices to all clients and a detailed quote with time and materials laid out before confirmation of the work. If the nature of the work changes due        to unforeseen circumstances or, if via the process of carrying out the work more time is required to complete the job, this will be addressed verbally or via email        during the course of the work. If possible, any unforeseen work or variations will be agreed before commencement to a fixed quotation where possible.

10. Any typographical, clerical or other error in quotation, invoices or other documentation issued by Sam will be subject to correction without any liability.

​Cancellation

11. Cancellation policy:

     (a) After a deposit confirmation, Sam requires 21 days notice to cancel work and return the deposit fee;

     (b) Sam reserves the right to charge for 50% of the quoted cost of his time if the Client cancels within 21 days;

     (c) If the Client delays the work, 14 days notice must be given,  if this is not possible Sam reserves the right to charge an administration fee for the change of date.

     (d) If the Client needs to postpone the agreed work due to unforeseen circumstances, the next available date will be given.

Client obligations â€‹â€‹

12.  As a Contractor, Sam always aims to keep you informed and up to date with any changes to the agreed work. He asks that as the Client you will commit to                   doing the same.

13.  The Client will  provide complete and accurate information as requested and provide keys, alarm codes, and access.

14   The Client will prepare the property and clear the area of works.​​

15.   Co-Operation:

       (a) The Client will co-operate with Sam and provide him with any information reasonably required to carry out the works in a timely fashion;

       (b) The Client will be responsible for the provision of reasonable access to water, electricity and toilet facilities at their cost;

       (c)  The Client will make available, reasonable secure storage space for the duration of the works for tool storage;

       (d)  Responsibility for all materials delivered to the site shall be at the Client’s risk.

Property Maintenance Services

16. Sam will ensure that Maintenance Services are performed with reasonable care and skill and to a reasonable standard which is consistent with best trade                    practice. 

17. Sam  will ensure that no parts of the property suffer damage as a result of the agreed work..

18. If Sam charges work by the day this is a 7 hour day of work.

19. If for any unforeseen circumstance, such as illness, Sam is unable to undertake the work on the agreed date, he will carry out the work as soon as possible. He            will call or email the Client to confirm this.

20. Gas and Electrical Equipment/Appliances. Owing to insurance restrictions Sam cannot fit, adjust or attend to any electrical, gas or plumbing equipment.

21. Damage. Whilst all due care and diligence will be taken, Sam cannot be held responsible for any cracking or damage that may occur by movement or vibration          during the course of the works.

22. Dust/Dirt. Whilst all due care and diligence will be taken, Sam cannot be held responsible for any dust/dirt that may be caused during the period of work. In               addition he cannot be held responsible for any damage caused to personal items left within the work area. These should be relocated or covered before arrival         on site.​​​

Materials

23. Materials provided by Sam and the client are pre-agreed and included in the estimate/quotation.

24. The costs of all materials are requested prior to the start of any job. Only listed items are included in the price.

25.  If a supplied part is faulty during fitting, it will be replaced and may incur extra costs. If faults occur after completion, a return visit fee will apply.

26.  Sam is not responsible for delivery failures or delays caused by third parties.

27.  No liability is accepted for faults in materials provided by the customer.

28.  Sam reserves the right to refuse installation of unsuitable materials supplied by the customer.

General terms 

29.  By agreeing to the terms and conditions, as the Client you grant me permission to use photos of  completed work for promotional purposes.  The intended use         of the photos are limited to marketing, website and social media. If you do not agree please inform me in writing by email when agreeing to the terms and                 conditions for work. 

30.  By making a booking via phone, email, or accepting an estimate following a visit, you confirm that you have read, understood, and agreed to these terms and           conditions.

Completion of Works​

31. Upon the completion of agreed works,  Sam asks that the Client ensures they are available in person to review the work. If this is not possible it should be                    discussed by email before the works are commenced.

32. Once approved, Sam will send an invoice with the remaining balance, minus deposit and materials costs. This  full and final balance will be due within 48 hours.​​

Payment and Booking Terms 

33. Unless otherwise agreed, 15% of labour costs to be paid as a deposit on confirmation of booking.

34. A deposit invoice is issued once the quotation/estimate is accepted.

35. The final balance is to be paid  by cash, BACS or Square phone payment within 48 hrs of the invoice date after completion of the works and the final invoice            is received. Cheques are by prior agreement.

36. For larger contracts of more than a week or over £2,000.00, a deposit and payment terms are agreed upon on an individual basis.

​Law and Jurisdiction

37. Client Delays: If the customer causes delays to the project timeline, then Sam reserves the right to adjust the schedule and pricing accordingly.

38. Sam reserves the right to terminate any agreement without notice in the event of non-payment, unreasonable conduct, or breach of these terms. Any deposits          paid are non-refundable in such circumstances.

39. Limitation of Liability: Sam shall not be liable for indirect, incidental, or consequential loss or damage, including loss of profits, unless caused by gross                          negligence or wilful misconduct.

40. Dispute Resolution: In the event of a dispute, both parties agree to attempt amicable resolution prior to initiating legal action. Should a resolution not be achieved, disputes may be referred to an independent mediator or adjudicator before proceeding to court.

41. Sam asks that if clients are unhappy with work this is raised in person at the final work review. Should Sam not receive notification of a dispute at the review,                payment is due within the agreed terms. 

42. Sam is GDPR compliant. Your personal information is securely stored and handled in accordance with the Privacy Policy.

43. Force Majeure: neither party shall be liable for any default due to any act of God, war, strike, lockdown, industrial action, fire, flood, drought, tempest or other             event beyond the reasonable control of either party.

44. Law: This contract is subject to the law of England and Wales.
